1. Introduction

Welcome to OpenAccessLane ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our website and the yacht charter services provided by OpenAccessLane at openaccesslane.site.

By confirming a booking or utilizing our Service, you are consenting to these Terms. If you do not accept any portion of these terms, you should not access the Service.

2. Service Overview

OpenAccessLane offers first-class yacht charter services, with offerings that include:

• Day-long yacht rentals
• Evening cruises
• Corporate events
• Exclusive gatherings
• Extended charters

Our services are dependent on availability and weather conditions. We hold the right to change or cancel services without prior notice.

3. Booking and Reservations

3.1 Booking Process

For reserving a charter, you are required to:

• Attain the age of 18 and above
• Provide truthful and complete information
• Send the necessary deposit as indicated in your booking confirmation
• Consent to these Terms & Conditions

3.2 Confirmation

A booking is only considered confirmed after we receive the payment and you have received our written confirmation. We reserve the authority to decline service at our judgement.

3.3 Availability

All yacht charters are subject to the availability of vessels and favorable weather conditions. We strive to accommodate your preferred scheduling.

4. Payment Terms

4.1 Pricing

Pricing is given in € and includes any applicable taxes, unless stated otherwise. Prices may change at our discretion.

4.2 Payment Schedule

• Deposit: 50% of the entire charter cost required at the time of reservation
• Remaining Balance: To be paid 48 hours prior to the charter's departure
• Any additional expenses (if any): Due upon completion of the charter

4.3 Payment Methods

We welcome payments via major credit cards, electronic bank transfers, and certified bank drafts. All payments are processed through secure and encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• Above 72 hours from departure: Entire refund besides processing charges
• Between 24 to 72 hours from departure: Half of the refund
• Under 24 hours from the time of departure: No refund is provided

5.2 Weather Cancellations

In cases where the weather is deemed unsafe by our captain, the options provided include:

• Rescheduling the charter to another available date without extra fees
• Issuing a full refund if rescheduling isn't an option

5.3 Mechanical Issues

If the vessel you're assigned encounters mechanical issues, we will attempt to provide an appropriate alternative. If this is not possible, you will receive a full refund.

6. Safety and Conduct

6.1 Safety Requirements

All passengers are expected to:

• Comply with all instructions given by the crew
• Utilize the safety equipment as instructed
• Notify of any medical conditions that could impact their safety
• Stay within designated areas on the vessel

6.2 Prohibited Items

The following are not allowed on board:

• Glass containers
• Illegal substances
• Weapons
• Excessive alcohol (beyond what's considered reasonable for consumption)
• Pets, unless prior approval has been granted

6.3 Conduct

Passengers are required to behave in a respectful and courteous manner at all times. Should a passenger's conduct jeopardize the safety or interfere with the experience of others, we hold the right to immediately cancel the charter without issuing a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the paid amount for the charter and do not take responsibility for:

• Personal injuries caused by passengers' own negligence
• Theft or damages to personal belongings
• Indirect or consequential losses, or punitive damages
• Delays resulting from weather or other factors beyond our control

7.2 Insurance Coverage

OpenAccessLane retains comprehensive marine insurance for our crewed vessels and operational activities. It is incumbent upon passengers to have their travel and personal insurance cover.

7.3 Assumption of Risk

By participating in our yacht charters, you recognize that maritime activities carry intrinsic risks and you assume full accountability for your personal safety and effects.

8. Modifications and Itinerary Changes

We may modify itineraries, courses, or timetables due to weather, safety concerns, or other operational needs. We aim to provide alternative arrangements of similar value wherever feasible.

9. Force Majeure

We shall not hold responsibility for any interruptions, adjustments, or cancellations caused by events beyond our influence, which can include but are not exclusive to:

• Extreme weather events
• Natural catastrophes
• Regulatory directives
• Port shutdowns
• Unforeseen technical failures

10. Privacy and Data Protection

Your proprietary data will be managed in line with our Privacy Policy. Engaging our services implies agreement to our data collection and usage as outlined in the Privacy Policy.

11. Intellectual Property

All contents available on our platform, including but not limited to text, visuals, trademarks, and photography, are under copyright and trademark protection. Reproduction, dissemination, or creation of derived works is prohibited without express consent from us.

12. Governing Law

The Terms are subject to enforcement under the laws of Germany. Any legal disputes will be adjudicated in the courts situated in Hamburg, Germany.

13. Changes to Terms

We retain the right to amend these Terms at our will. Notice of any changes will be indicated on our service platforms with a notice of revision. Your continuous use of our services will be deemed as agreeing to the amended Terms.
